Kibaki’s move illegal, declares

ODM Tuesday described the naming of Cabinet by President Kibaki as
illegal.

The party’s
secretary-general, Prof Anyang’ Nyong’o, said everything done
by Mr Kibaki remained unlawful including his swearing in as
Head of State.
“He is living in denial and trying to hide his face under the
presidency he acquired illegally. We are not ready to behave
in that manner and international community should now
understand the essence of mass action in Kenya. This is a new
black spot in world democracy,” he said at a Kajiado hotel.
Prof Nyong’o said naming ODM-Kenya leader Kalonzo Musyoka as
his deputy was expected. He alleged that Mr Musyoka had
pressured Electoral Commission of Kenya chairman Samuel
Kivuitu to announce results out of political opportunism.

Earlier, ODM leader Raila Odinga
said President Kibaki had not officially invited him for the
Friday meeting and insisted international mediation was his final
means of solving the crisis.
Mr Odinga said Mr Kivuitu’s statement that he did not know whether
President Kibaki won the election was reason enough to call for
repeat of the presidential contest.
Mr Odinga said it was unfortunate for top Kibaki government
officials to claim that Mr Kufuor, who is the African Union
chairman, “should just come to take tea with President Kibaki”.
“I feel the international community is taking the matter more
seriously than Mr Kibaki’s top advisers and consider the words
used against Mr Kufuor an insult. The issue is about conducting a
re-run with a neutral body other than the ECK since Mr Kivuitu has
even been struck from the roll of advocates,” he said.
He told the British Broadcasting Corporation that US assistant
secretary for African Affairs Frazer Jendayi handled President
Kibaki with “ kids gloves”.
Mr Odinga who had attended an ODM parliamentary group meeting,
said he was rigged out and cannot recognise President Kibaki’s
leadership.
ODM chairman Henry Kosgey and Prof Nyong’o told the media that
they “will elect a Speaker and deputy then decide how our MPs will
be sworn in”.
Emuhaya MP-elect Kenneth Marende was proposed for the position of
Speaker and his Lagdera counterpart Farah Maalim for the deputy.
“We have the capacity to fight back and the House floor will be
our grounds,” said Mr Kosgey.
