Ogiek Released on Kshs.10,000 cash Bail!

But more legal funds needed.


Njoro - Kenya, 30. April 2007

In a recent meeting held in Nessuit on Saturday, it was discovered that one of the leading Ogiek human rights crusader's, Alex Naishuru, was missing. After several unsuccessful attempts to trace him through cell phone, the Ogiek leaders, led by Daniel Kobei, visited the Njoro police station to report of his disappearance.

The Officer Commanding Station (OCS) of the station admitted that Alex Naishuru was under arrest and will be produced in court on Monday (today). He went further to decline the request by the leader's to interact with him or to provide him with food. 

This morning, Alex under serious police escort was transfered 15 Km to Nakuru court, where he was charged with creating disturbance.

Without a lawyer (but with the mercy of GOD), Alex, who denied the offence, was released on a cash bail of Kshs. 10,000 (US 150.-). The case will be heard on 15th of June 2007. 

The lawyers (Kiplenge and Ogola) had not assisted this case, because they still demand for the payment for the past Ogiek defence cases. Based on their quotation send to our offices in Nakuru, a total of Kshs. 300,000 is needed. They had previously provided their services to more than 21 human rights cases from Nessuit, Mariashoni and Sururu. 

OPDP was only able to raise the cash bail for Alex, paid the amount, and he is now free.

In a meeting that was held in Nessuit, the community informed in detail on the proceedings of the High court Civil Application no.635/1997. The lawyer (Dr.Gibson Kamau Kuria based in Nairobi) had sent a quotation of Kshs.1.2milion for the finalizing of the case sooner before the general election. The Ogiek members nominated a group of six people to collect money for the fees of the advocate before the deadline of May 10th. All Ogiek supporters and well wishers can contribute to the lawyer account.
