HON. AMOS KIMUNYA

MINISTER FOR LANDS

REPUBLIC OF KENYA

P.O BOX.

ARTHI HOUSE

NAIROBI.

DEAR SIR,

RE: TINET SETTLEMENT SCHEME - PROGRESS OF BIASNESS, CORRUPTION, VIOLENCE AND OR DISPLACEMENT OF GENUINE OGIEK.

This is kindly to bring the above subject to your attention, that has made the genuine Ogiek as squatters in all areas inhabited by them.

Since the NARC took over the power, President Kibaki has been on the forefront to condemn corruption. In his both speeches when being sworn in and opening the ninth parliament, he urge all Kenyans to assist in fighting and condemning corruption.

Your ministry have tried it best to reclaim all grabbed chunk of lands, nullify all illegal tittles Deeds, and setting up the Kenya Land Commission to inquire on illegal lands allocation. The target was on forests, public utility, water catchments areas and inter-alia.

Since the president announce through your consultation that Ogiek be issued with tittles deeds within three months, the wealthy individuals have gone ahead to benefit from the lands intended for only Ogiek. Meeting have been hold secretly without involving Ogiek professionals, leaders, civil societies, religious sectors and friends.

It was recently in Keringet Market that the Deputy Provincial Commissioner who is among the KANU beneficiaries of lands evicted the civil societies and professionals from the meeting hall. The D.P.C Mr. Reuben Rotich is an interested party in the settlement and protects the so-called “ Kipsangany and Karandit ” clans, which is a mixture of the Tugen, Nandi and Kipsigis people. He deserves urgent sacking or demotion and or transfer out of Rift valley province.

The fact of the problem is the love of money by the committee than the poor community. The banned committee are the same who inserted non- Ogiek members from Bureti, Baringo, Naivasha, Kericho and Eldoret among others into the so-called Blue Book.

The powerful individuals therefore own huge chunks while the poor Ogiek owns nothing and or five acres. The Ogiek who sued the former regime from evicting them are the one being displaced by the mighty. What a corruption?

Powerful individuals with heavy vehicles are being welcomed to the houses of the same committees daily while the poor Ogiek are denied a chance to defend their already sold land. From the field and observational survey the committees have been liasing with the surveyors from Nakuru in issuing lands to the mighty and wealthy persons. The forest is facing extinction from this foreigners who are not used to live with trees like Ogiek do.

We thus call upon your office to ban all the fifty-four committee and liased with the Kenya Anti Corruption Authority to immediate investigate and prosecute leaders involve with any act of corruption. The area MP (Kuresoi) Mr. Moses Cheboi has played no roll to the problem in the name of protecting his voters from eviction. There is suspicion that the area councillor who is among the committee provided him with a huge chunk..

Sir, your office should establish an immediate independent taskforce comprising of CSOs, NGOs, religious sectors and Ogiek professionals to resettle the Ogiek and have a genuine list published. Hence the Ogiek should be issued with title deeds of 10 acres per family of husband and wife. The genuine Ogiek are few than the claimed 5,016 people.

With the few remarks, we intend to visit your office sooner than later for more consultation and interaction so as Ogiek can achieve their daily dream of reaching Canaan.

Hoping for your reply soon than later.

Yours Faithfully,

-----------------------------
